New requirements for collection of personal information in Aotearoa New Zealand
15 May 2026
Policy
The NZ Privacy Amendment Act 2025 introduced a new Information Privacy Principle 3A (with a corresponding amendment to the Health Information Privacy Code). It requires agencies to notify patients when they have received indirect information about them, including referral letters or other correspondence containing health information.
NZ-based psychiatrists working in private practice may wish to review their privacy statements and processes to ensure compliance with the new principle.
Detailed information regarding the requirements and exception and implementation guidance is available on the website of the Office of the Privacy Commissioner.
