Policy
In March 2025, the Australian Department of Health and Aged Care released the Health Provider Compliance Strategy 2025–30. The strategy highlights the obligations of practitioners when making a Medicare claim. A core principle of the strategy is its emphasis on educating practitioners in a supportive manner.
The Department also released the Health Provider Compliance Priorities 2025, which has identified eight key areas of common non-compliance. Members are encouraged to review this document as an ongoing supportive resource.
The third area of non-compliance, Claiming MBS services while overseas, serves to reinforce to College members that Medicare benefits cannot be claimed for services provided when either the practitioner or the patient is outside Australia. Members are also advised that they are considered PBS prescribers only when practicing in Australia or eligible external territories. PBS prescriptions issued from overseas are not eligible for patient benefits under Section 89 of the National Health Act 1953.
Further guidance is available in the Medical Board of Australia: Telehealth consultations with patients.
