Final report on review of the family law system

The Australian Law Reform Commission’s (ALRC) report, Family Law for the Future: An Inquiry into the Family Law System was tabled in Parliament yesterday by Attorney-General Christian Porter MP.

The College has consistently advocated for better protections for the confidentiality of clinical records to prevent their misuse in the family law system. See our Position Statement for more information.

As such, we welcome Recommendation 37, amending the Family Law Act 1975 (Cth) to provide courts with an express statutory power to exclude evidence of ‘protected confidences’ – including medical records.

The College welcomes the extensive recommendations made in the final report.
